SPECIALISED FORA CREATED BY STATUTES HAVE EXCLUSIVE JURISDICTION OVER SUBJECT MATTERS BESTOWED – SC

Dictum

U.B.N. Plc v. S.E.C. (2026) 8 NWLR (Pt. 2045) 277 at 303, D—E: ‘It should further be noted that the law is settled that where there is a special forum prescribed by a statue, for the enforcement of a right, that forum must be used to the exclusion of all others. InF.R.N. v. Solomon (2018) 7 NWLR (Pt. 1618) 201 at 216, the court affirmed that where a specialized tribunal is created for a subject matter, the jurisdiction of regular courts is ousted. Foreign law aligns with this principle. In the U.S. Supreme Court in Thunder Basin Coal Co. v. Reich, 510 U.S. 200 (1994) held that where Congress creates a specialized administrative review scheme, jurisdiction of federal courts is impliedly precluded.’
