BECAUSE THERE WAS NO BAILIFF ENDORSEMENT

Dictum

It is straining the rule on proof of service to say that a defendant who filed a defence to a statement of claim was not served with the writ of summons because there was no bailiff’s endorsement on the writ.

— Olatawura, JSC. Okesuji v Lawal (1991) – SC.162/1986
